Davis & Elkins College will host the West Virginia Intermediate Court of Appeals on Tuesday, September 17, beginning at 9:30 a.m. in Harper-McNeeley Auditorium in the Myles Center for the Arts. The event is open to the public and will allow attendees to see the inner workings of the court and learn about the legal process.

Four arguments that will be heard: In re: Expungement of Record of N.B., 23-ICA-430; A.D.A., as next friend of L.R.A., a minor child under the age of 18, et al. v. Johnson & Johnson, et al., 23-ICA-275, 23-ICA-276, 23-ICA-287, and 23-ICA-307; Damon McDowell, Mary McDowell, and DeeAnna Rae Lawson v. Allstate Vehicle and Property Insurance Company, 23-ICA-406; and The Silver Creek Association, Inc., et al. v. Matthew Irby, in his official capacity as State Tax Commissioner of the State of West Virginia, and Johnny Pritt, in his official capacity as Assessor of Pocahontas County, West Virginia, 23-ICA-372.

Judges serving on the Intermediate Court of Appeals include Chief Judge Thomas E. Scarr, Judge Charles O. Lorensen, and Judge Daniel W. Greear. Judges are elected in nonpartisan elections to ten-year terms while the Chief Judge is chosen by members of the Court and serves a one-year term. Judges must have practiced law for at least ten years.

Chief Judge Scarr shared, “We really look forward to having oral argument on campus at Davis & Elkins, and also the opportunity in advance to meet and talk with the students. It is particularly special to host this event on Constitution Day.”

Judge Lorensen noted, “We hope this provides an opportunity for Davis & Elkins students and others to gain insight from attending arguments about interesting legal issues at their home campus.”

Judge Greear said, “This is our third ICA On-Campus and we are privileged to partner with Davis & Elkins College to make this event a success.”

Davis & Elkins College President Chris Wood shared, “We are thrilled to welcome the West Virginia Intermediate Court of Appeals to our campus, particularly on Constitution Day, a day dedicated to celebrating and understanding our nation’s founding principles. The Judges’ outreach and engagement with D&E students in classes and across campus, coupled with the invaluable opportunity to witness oral arguments firsthand, will undoubtedly deepen their understanding of the judicial process.” Wood continued, “We’re equally excited that their outreach extends to West Virginia Wesleyan College, local high schools, and the local community. This experience will underscore the importance of civic engagement and inspire the next generation of leaders in our state.”

The judges and members of their staff will present lectures and lead discussions in Davis & Elkins College Political Science and Criminology classes in the coming week. They will also visit West Virginia Wesleyan College, Elkins High School, and Tygarts Valley High School.

The West Virginia Highlanders will open the proceedings with the presentation of flags at 9:25 a.m. Questions will be taken from the audience as time allows.
